August 14 and 10, the Governors of Illinois HB 4404 and SB 2615, which amended the Illinois Residential Mortgage License Act of 1987, entered into force on August 14 and 10, respectively. With immediate effect, SB 2615, now Public Act 100-0795, will require, inter alia, that mortgage credit notices in Illinois, whether printed or electronically, refer to the Nationwide Multistate Licensing System (NMLS) and the Registry's Consumer Access Website, unless they are exempt from the Secretary of Financial and Professional Regulation.
Under HB 4404, now Public Act 100-0851, a firm which deals exclusively with independently servicing credit through sponsorship of individual persons is deemed to be exempted from the approval requirement of the Residential Mortgage License Act but is obliged to request through the NMLS, on an annual basis, an exempted business registry for the sponsorship of one or more licenced mortgage lenders.
