In the U.S. District Court for the Southern District of Texas, a U.S. state panel of judges ruled that a mortgage provider and its chairman and chief executive officer were held responsible for nearly $93 million related to allegations of breaches of the False Claims Act (FCA) and the Financial Institutions Reform, Recovery and Enforcement Act of 1989 (FIRREA) before the triple and infringement fines provided for in the articles were imposed.

Those allegations relate to the lender's involvement in the Federal Housing Administration (FHA) mortgage policy. Total US $92,982,775 in compensation was awarded by the judges, of which $7,370,132 was against the mortgage lender's Chairman and Chief Executive Officer. Furthermore, the FCA imposes triple and peremptory fines of $5,500 to $11,000 for each offence, while FIRREA also allows fines for each offence.

At a later date, the Supreme Court, which chaired the case, will decide on the overall penalty and compensation. Initially, the complaint was brought as a qui tatam whistleblower complaint in the U.S. District Court for the Southern District of New York, in which the United States interfered. Subsequently, the suit was adjudicated in the U.S. District Court for the Southern District of Texas.
